1. Introduction and Agreement to Terms

Welcome to Fariid ("we," "our," or "us"), a mobile application and platform owned and operated by Loola AI Inc. These Terms and Conditions ("Terms") govern your access to and use of:

  1. The Fariid website (fariidapp.com);
  2. The Fariid mobile application (the "App"); and
  3. Any web-based applications, portals, or platforms provided by us (collectively, the "Service").

PLEASE READ THESE TERMS CAREFULLY. BY CLICKING "SIGN UP," "LOG IN," OR BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

2. Eligibility and Age Restrictions

The Services are not intended for users under the age of 16. By using Fariid, you represent and warrant that:

  1. You are at least 16 years of age.
  2. If you are between the ages of 16 and the age of majority in your jurisdiction, you have obtained the consent of your parent or legal guardian to use the App and agree to these Terms.
  3. You have the full power and authority to enter into this agreement and doing so does not violate any other agreement to which you are a party.
  4. You represent and warrant that: (i) you are not listed on any U.S. Government list of prohibited or restricted parties, including the Office of Foreign Assets Control’s (OFAC) Specially Designated Nationals and Blocked Persons List; and (ii) you will not use the Service for any purposes prohibited by U.S. law, including the development, design, manufacture, or production of missiles, nuclear, chemical, or biological weapons.

3. User Accounts and Social Login

3.1 Account Creation

To access certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Social Login

We provide the option to register and log in using third-party social media details (e.g., Google, Apple, Facebook). By choosing this option:

  • You authorize us to access and use certain information from your social media profile (such as your name, email address, and profile picture) consistent with your privacy settings on that platform.
  • You acknowledge that your relationship with the third-party service provider is governed solely by your agreement with that provider.

3.3 Account Security

You are responsible for safeguarding your password and account details. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscriptions and Payment Terms

4.1 Mobile Money Transactions

Fariid integrates with third-party mobile money payment processors, specifically Sifalo and Waafi, to facilitate subscription payments.

  • By initiating a transaction, you authorize us and our third-party processors to charge your mobile money account for the designated amount.
  • You acknowledge that we do not directly control the transaction speeds or technical availability of the mobile money networks (e.g., Zaad, E-Dahab).

4.2 Pricing and Taxes

All prices are subject to change without notice. You are responsible for any applicable taxes, data charges, or mobile carrier fees associated with your use of the App.

4.3 Refunds

Except when required by law, paid subscription fees are non-refundable. Certain refund requests for subscriptions may be considered by Fariid on a case-by-case basis and granted at the sole discretion of Loola AI Inc.

5. AI Services and Voice Data

5.1 Nature of AI Services

Fariid utilizes artificial intelligence, including technologies provided by OpenAI, to generate language exercises, conversation simulations, and feedback.

  • Accuracy Disclaimer: You acknowledge that AI technology is experimental and rapidly evolving. The App may occasionally produce incorrect information, grammatical errors, or "hallucinations." Fariid should be used as a supplementary learning tool and not as a sole source of truth for language accuracy.

5.2 Voice Recording License

To use the speaking features, you must provide voice inputs. By using these features, you grant Loola AI Inc. a worldwide, non-exclusive, royalty-free license to record, process, and store your voice inputs solely for the purpose of providing the Service, improving our AI models, and analyzing your learning progress.

6. Intellectual Property Rights

6.1 Our IP

The App, including its text, graphics, images, code, software, AI models, and the "Fariid" logo, is the property of Loola AI Inc. and is protected by copyright, trademark, and other intellectual property laws of the United States and international treaties.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of the App on a mobile device and to run such copy of the App solely for your own personal, non-commercial purposes.

7. Prohibited Activities

You agree not to do any of the following:

  1. Use the App for any illegal purpose or in violation of any local, state, national, or international law.
  2. Attempt to reverse engineer, decompile, disassemble, or derive the source code of the App.
  3. Harass, threaten, demean, or intimidate other users or Fariid support staff.
  4. Use the App to transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature.
  5. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  6. Exploit the AI features to generate hate speech, violence, or sexually explicit content.

8. Third-Party Links and Services

The App may contain links to third-party websites or services (e.g., Sifalo, Waafi, OpenAI) that are not owned or controlled by Loola AI Inc.

  • We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
  • You acknowledge and agree that Loola AI Inc. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOOLA AI INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS, OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, OR INFORMATION PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOOLA AI INC., ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

IN NO EVENT SHALL LOOLA AI INC.’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED U.S. DOLLARS ($100).

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration in Delaware, US. However, if you are a resident of Somaliland utilizing our regional services, we reserve the right to seek injunctive relief or enforce these Terms in the competent courts of Somaliland to protect our intellectual property or commercial interests.

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
